1. Acceptance of Terms

By accessing or using the website greenforeverarizona.com (the "Site") or any services provided by Green Forever Arizona, also doing business as JDC Service, Inc ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or services.

Green Forever Arizona is a licensed Arizona contractor (ROC #324435) headquartered at 1507 S. Country Club Dr., Mesa, Arizona 85210.

2. Services Description

Green Forever Arizona provides outdoor living and landscaping services throughout the Phoenix metropolitan area, including but not limited to:

• Artificial turf installation (residential and commercial)
• Paver installation (travertine, porcelain, and concrete pavers)
• Patio covers, pergolas, and shade structures (branded as SunGuard Shade Solutions)
• Landscape design and consultation
• Turf cleaning and maintenance (branded as TurfSpa)
• AI-powered yard visualization tool ("GFA Visualizer")

3. AI Visualizer Disclaimer

Our GFA Visualizer tool uses artificial intelligence to generate renderings of potential outdoor transformations based on photos you upload. Please be aware of the following:

• Illustrative purposes only. All AI-generated renderings are conceptual and intended to provide a general idea of what your outdoor space could look like. They are not exact representations of the final result.
• Actual results may vary. Factors such as existing site conditions, material availability, property dimensions, grading, drainage, and other variables will affect the final outcome of any project.
• Not a binding quote. Any pricing estimates or square footage calculations provided through the Visualizer are approximate and do not constitute a binding quote, contract, or commitment. All final pricing is determined through an on-site evaluation.
• AI limitations. The Visualizer uses Google Gemini AI technology. AI-generated images may contain inaccuracies, artifacts, or imperfections that do not reflect our actual workmanship or materials.

4. Quotes and Pricing

All quotes and estimates provided by Green Forever Arizona, whether through the Visualizer, over the phone, via email, or in person, are subject to the following conditions:

• Final pricing requires an on-site evaluation by our team.
• Quoted prices are valid for 30 days from the date of the quote unless otherwise stated.
• Prices may change due to material cost fluctuations, site conditions discovered during installation, scope changes, or other unforeseen circumstances.
• Any changes to the agreed scope of work may result in additional charges, which will be communicated and approved before work proceeds.

5. Warranties

Green Forever Arizona stands behind the quality of our work. Our warranty terms include:

• We offer industry-leading warranties of 15+ years on qualifying artificial turf installations, covering manufacturing defects and workmanship.
• Specific warranty terms and coverage details are provided in writing with each project contract.
• Warranties may be voided by misuse, unauthorized modifications, neglect, acts of nature, or failure to follow recommended maintenance guidelines.
• We are a licensed and bonded Arizona contractor (ROC #324435). All work is performed in compliance with applicable local, state, and federal regulations.

6. Payment Terms

Payment terms are specified in your individual project contract. General terms include:

• A deposit may be required to schedule your project and secure materials.
• Progress payments may be required for larger projects as outlined in your contract.
• Final payment is due upon project completion and your satisfaction with the work performed.
• We accept various payment methods including check, credit card, and financing options through our approved lending partners.
• Late payments may be subject to interest charges as permitted under Arizona law.

7. Limitation of Liability

To the maximum extent permitted by Arizona law, Green Forever Arizona and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of, or inability to use, the Site or Visualizer tool.
• Any reliance on AI-generated renderings, estimates, or content provided through our Site.
• Any errors, inaccuracies, or omissions in Site content.
• Any unauthorized access to or alteration of your data or transmissions.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us for the specific service giving rise to the claim.

8. Intellectual Property

All content on this Site, including but not limited to text, images, graphics, logos, designs, AI-generated renderings, and software, is the property of Green Forever Arizona or its licensors and is protected by U.S. copyright and trademark laws.

• Custom designs, plans, and AI renderings created for your project remain the intellectual property of Green Forever Arizona.
• You may not reproduce, distribute, or commercially use any designs or renderings without our written consent.
• The names Green Forever Arizona, JDC Service, Inc, SunGuard Shade Solutions, TurfSpa, and GFA Visualizer are trademarks of Green Forever Arizona.

9. User Content

When you upload photos or other content to our Visualizer tool or submit information through our Site:

• You represent that you have the right to share the content and that it does not violate any third party's rights.
• You grant Green Forever Arizona a non-exclusive, royalty-free license to use the uploaded content for the purpose of providing our services, including generating AI renderings and project estimates.
• We may use anonymized or aggregated data from user interactions to improve our services and AI tools.
• You are responsible for ensuring that any photos uploaded do not contain sensitive personal information visible in the image.

10. Third-Party Services

Our Site and services integrate with third-party platforms and technologies, including:

• Google Maps API: Used for location services, address lookup, and mapping. Your use is subject to Google's Terms of Service and Privacy Policy.
• Google Gemini AI: Powers our AI Visualizer renderings. Photos you upload are processed through Google's AI services.
• Netlify: Provides website hosting and form processing services.

We are not responsible for the practices, content, or policies of these third-party services. We encourage you to review their respective terms and privacy policies.

11. Termination

We reserve the right to suspend or terminate your access to the Site or any of our online tools at any time, without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Termination of Site access does not affect any existing project contracts, which are governed by their own terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.
